Somebody should sue the Lakers
the League for that malicious and vicious hit that thug leveled on Harden. Oh, and ABC should be sued as well for encouraging thugs like Artest to take shots on the court that would not be allowed anywhere else in society without legal liability.
Watching the pre-game show the studio crew mentioned that Lakers should set a physical tone, and would it surprise you to know that Artest was one of the candidates nominated for the duty of enforcer for the Lakers. Little wonder the thug takes it upon himself to hit the other teams start player viciously.
Here is why the various parties are liable. I have already mentioned the culpability of the studio crew for suggesting that these physical messages need to be sent for the playoffs. They are exposed for the suggestion that could encourage players to hurt others.
Lakers, they are definitely exposed for hiring this thug and putting him on the court to assault other players with non basketball moves. It could be argued that the Lakers were aware of his propensity for violence when they played him in the playoffs as a Rockets
player and he assaulted their start player Kobe Bryant
. In fact one of the stated reasons for gettung him was for his physical play (read thuggish play). Another theory of liability against the Lakers is ratification if the Lakers put this thug back on the court without independent psychological clearance after suspending him for the rest of the season then they should be held to have ratified his thuggery, and held liable for his damages.
The league should be liable for allowing this guy to play in their game without psychological clearance. The league profits from games and encourages impressionable kids to watch these games. The kind of shot that was leveled on Harden by Artest could damage some kids for emotionally, especially kids that are fans of Harden.
There should be no place for the vicious and malicious hit Artest put on Harden, and he should be suspended for the balance of the season.
This is what happens when you let Bynumm get away with what he did last year to JJ Barrea. I always felt that Bynumm's five game suspension should have been served in the playoffs not the regular season. He comitted the foul in the playoffs, the punishment should be served in the playoffs.
